Mass. teen indicted after crash that left 1 dead, others injured

A Cape Cod teenager was indicted on Wednesday after authorities said he crashed an SUV carrying six other teens into a tree in Mashpee over the summer, killing one and hurting five others.

The Barnstable County Grand Jury handed down two indictments against Jack Burns, 17, charging him with operating a motor vehicle recklessly resulting in a death, and assault and battery with a dangerous weapon resulting in serious bodily injury, according to a statement from the Cape and Islands District Attorney's Office.

Burns' arraignment date in the Falmouth Juvenile Court has not yet been scheduled.

The Cape Cod teenager lost control of a Toyota RAV4 he was driving, left the road and crashed into a tree in Mashpee on June 25, according to the Mashpee Police Department.

The crash occurred on Carleton Road near Swain Circle around 2:08 a.m. Six teens, who were passengers, were injured, including two who had life-threatening injuries. Both of them were brought to Cape Cod Hospital, where Nolan Barr, 17, of Mashpee, later died.

The other teens who were hurt were taken to South Shore Hospital. One of them was in stable condition, while the three others had non-life-threatening injuries. The last teen didn't need medical help at all.

The teenagers, who ranged in age from 15 to 17 and were from Falmouth and Mashpee, had crammed into a Toyota RAV4, which typically seats five people, the police said.
