MedMen, a bankrupt medical marijuana dispensary in Amherst, has been evicted from its space at the corner of Main Street and Transit Road and is being sued for nearly $70,000 in back rent.

Rochester-based Flaum Management affiliate ALS Main and Transit LLC filed a suit in Erie County Supreme Court against the dispensary last week, alleging that the company owes $69,718 in rent, interest and attorney's fees.

According to invoices filed in the suit, unpaid rent payments date back to February. Some bills for common area maintenance and taxes go as far back as October 2023.

MedMen was evicted from 6842-6850 Main St. on Aug. 5.

According to the lawsuit, MedMen signed a 10-year lease in 2018.

California-based MedMen declared bankruptcy in Canada in April and its American subsidiary entered receivership for the dissolution and liquidation of its assets.

"The difficult decision to shut down operations and commence the Bankruptcy Proceedings and Receivership Proceedings was made after careful consideration of the current financial condition of the Company and its subsidiaries, their inability to pay their liabilities as they become due and the anticipated enforcement actions of secured creditors," the company said in April.

In its last four years of business, the company had five different CEOs.

Just six years earlier, when the company went public, it had been valued at more than $3 billion.

MedMen was one of the first dispensaries to open in California when cannabis became legal there. It had faced challenges related to its rapid expansion, took on significant debt and faced legal disputes over labor practices.

The medical marijuana industry in New York has been struggling as recreational cannabis use has become legal. More medicinal users have migrated away from medical vendors toward recreational ones or have begun growing cannabis themselves. And with the beleaguered state of New York's legal cannabis industry, medicinal operators have struggled to break into the recreational realm.
