A Texas federal district court denied summary judgment to Tona Keller on the claims of employees stating that they weren't paid full minimum and overtime wages, in violation of the Fair Labor Standards Act, and that Keller bears liability as the sole shareholder of Tranquility Gardens, the company employing the plaintiffs, ruling that there was sufficient evidence that Keller controlled work schedules and the conditions of employment, as well as the method of payment for the employees.
